Terms of Service

1. Acceptance and scope

These Terms of Service apply when you visit, create an account for, or use MedBuddy, the learning platform operated by MedCognito. By using the service, you agree to these terms. If you do not agree, do not use the service. Our Privacy Policy explains how we handle information connected with your account and use of the platform.

2. Educational service and AI-assisted features

MedBuddy provides question-bank practice, mock exams, flashcards, study planning, readiness insights, and related educational guidance for medical licensing exam preparation. Some summaries, explanations, flashcards, and study-plan guidance are generated or assisted by artificial intelligence using information from your activity, material you intentionally submit for a requested feature, and approved educational content. AI does not set your study tasks, dates, or workload. AI-assisted output may be incomplete or inaccurate and is not a substitute for authoritative sources, a qualified educator, or professional judgment. The service is for education only, is not medical advice, and must not be used to diagnose, treat, or make decisions about a person’s care.

3. Accounts and learner responsibilities

You must provide information that is accurate and current, keep your sign-in credentials secure, and promptly tell us about suspected unauthorized use. Do not impersonate another person or misrepresent your affiliation with a person or organization. Your account is for your own learning use; sharing credentials or paid access is not permitted. You are responsible for activity that occurs through your account unless it resulted from our failure to take reasonable security measures.

4. Content and acceptable use

We retain our rights in the platform, question bank, explanations, study materials, trademarks, and other content. Subject to these terms and any active access period, we grant you a limited, personal, non-transferable right to use the service for your own exam preparation. You must not copy, scrape, bulk-download, sell, publish, redistribute, or commercially exploit our content; reverse engineer or interfere with the service; bypass access controls; use automated access without permission; attempt to access another account; or use the service unlawfully or to harm others.

5. Learner-provided material and sensitive information

You retain your rights in notes or other material you submit to an optional free-text field. You represent that you have the right to submit that material and authorize MedCognito to process it to provide the requested feature. Do not submit patient-identifying information, protected or personal health information, confidential workplace or client information, passwords, or other sensitive information. MedBuddy is not designed to receive or process real patient cases or regulated clinical records. You are responsible for ensuring that material you submit is accurate, lawful, and does not violate another person’s privacy, confidentiality, or intellectual-property rights.

6. Access plans and purchases

The platform may include free learner access, access provided through an enrolled MedCognito Class, and paid access. The features, price, currency, and access period shown at checkout or activation apply to your purchase. The current paid options include a recurring monthly plan and one-time three- or six-month Exam Passes. A one-month extension may be offered to eligible pass holders. Exam Passes and extensions do not renew automatically. Access provided through a class or other program is subject to that program’s eligibility and stated duration.

7. Billing, cancellation, and refunds

Paid access is charged in advance using the payment method accepted at checkout. A monthly plan continues and renews at the displayed price until you cancel it through the available billing-management flow. Cancellation takes effect at the end of the current paid period; it does not create a partial-period refund or credit. One-time Exam Passes and extensions end when their stated access period expires. All purchases are final: we do not offer refunds, credits, or prorated refunds for unused time, non-use, a change of mind, a changed exam date, or failure to achieve a particular score or outcome. The only exceptions are where a refund is required by applicable law or where we confirm a duplicate charge, processing error, or other billing mistake.

8. Changes and availability

We may modify, suspend, or discontinue features, content, exam tracks, access plans, or parts of the service. Content and recommendations may change as the platform is updated. We do not guarantee that the service or any particular content will always be available, uninterrupted, error-free, current, or suitable for your particular exam plan.

9. Suspension and termination

We may suspend or terminate access when reasonably necessary to address a breach of these terms, fraud, a payment dispute or chargeback, security risk, unlawful activity, non-payment, or a risk of harm to the service or other users. Access suspended during a payment dispute may remain unavailable while the payment provider reviews the matter. You may stop using the service and request account deletion. If we terminate access because you breached these terms, you are not entitled to a refund. Information handling after deletion or termination is described in the Privacy Policy.

10. Disclaimers and no guarantees

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We do not guarantee the accuracy, completeness, or reliability of any content or AI-assisted output; that you will pass an exam, achieve a score, or reach a readiness level; that a recommendation will fit your circumstances; or that the service will meet your expectations. MedBuddy is an educational tool, not medical advice or a substitute for professional care.

11. Limitation of liability

To the maximum extent permitted by law, MedCognito and its representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunities arising from or related to the service. Our total liability for all claims relating to the service will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim.

12. Changes to these terms

We may update these terms to reflect changes to the service, law, or our practices. We will post the updated version with a new effective date and, where required, provide additional notice. Your continued use after the updated terms take effect means you accept them. If a provision is not enforceable, the remaining provisions continue to apply.
